Welcome to FX Intellect. These Terms of Service govern your use of our website, custom EA development services, MT5 tools, indicators, modules, subscriptions, downloads, and related services. By accessing or using FX Intellect, you agree to these Terms. If you do not agree, you must not use our services.

1. Eligibility

To use our services, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction.
  • Have the legal capacity to enter into a binding agreement.
  • Ensure that using trading tools, Expert Advisors, indicators, or automated trading software is legal in your jurisdiction.

2. Services Provided

FX Intellect provides custom development and access to trading-related software tools. Our services may include:

  • Custom MT5 Expert Advisor development based on client-provided strategy rules.
  • Custom indicators, trading tools, and automation modules.
  • Access to free and paid MT5 tools, including trade management tools and indicators.
  • Subscription-based access to selected modules, features, tools, updates, or support.
  • Technical support related to tools developed or provided by FX Intellect.

FX Intellect does not provide financial advice, investment advice, or guaranteed trading systems. We provide software development and trading tool services only.

3. Client Responsibilities

As a client or user, you agree to:

  • Provide clear, complete, and accurate strategy rules when requesting custom development.
  • Review and test any EA, indicator, or trading tool before using it on a live account.
  • Monitor your trading accounts and software settings regularly.
  • Use our tools in compliance with your broker, prop firm, and local regulations.
  • Take full responsibility for all trading decisions and outcomes.

You acknowledge that trading involves significant risk, including the possible loss of funds.

4. Custom Development

Custom development work is based on the instructions, rules, and requirements you provide. If your instructions are incomplete, unclear, or changed after development begins, additional clarification, time, or fees may be required.

FX Intellect may decline to build strategies or features that are unclear, technically unsuitable, misleading, abusive, or outside the scope of our services.

5. Revisions and Scope Changes

We may provide reasonable corrections where the delivered software does not match the agreed requirements. However, new features, changed strategy logic, additional filters, extra modules, or changes requested after development has started may be treated as new work and may require additional payment.

6. Subscriptions and Payments

Some FX Intellect services are available through subscription plans. By subscribing, you authorize us or our payment provider to charge your chosen payment method according to the selected plan.

Subscription access may depend on your selected plan, payment status, account status, and the features included in that plan.

7. Refund Policy

Payments made to FX Intellect are generally non-refundable. This includes custom development fees, setup fees, project deposits, subscription payments, and payments for digital products or software access.

8. Account Access and Termination

We may suspend or terminate your access if you:

  • Violate these Terms or any applicable law.
  • Misuse our services, tools, website, downloads, or systems.
  • Attempt to copy, resell, bypass licensing, or abuse our software.
  • Fail to pay required fees or subscription charges.
  • Engage in fraudulent, abusive, or harmful activity.

9. Intellectual Property

All software, tools, indicators, modules, code, designs, content, and systems provided by FX Intellect remain the intellectual property of FX Intellect unless otherwise agreed in writing.

You may not copy, resell, redistribute, reverse engineer, modify, share, or provide unauthorized access to our software, tools, or services.

10. No Trading Guarantee

FX Intellect does not guarantee profits, prop firm payouts, account growth, trading performance, risk reduction, or any specific financial result.

Backtests, examples, strategy discussions, indicators, robots, or software tools do not guarantee future results. You are responsible for deciding whether any tool or strategy is suitable for your own trading.

11. Limitation of Liability

To the fullest extent permitted by law:

  • FX Intellect is not liable for trading losses, missed trades, broker issues, prop firm rule violations, software misuse, VPS issues, or market-related losses.
  • FX Intellect is not liable for indirect, incidental, special, or consequential damages arising from your use of our services.
  • Your sole remedy for dissatisfaction with our services is to stop using the services.

13. Security

14. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on our website. Your continued use of FX Intellect after changes are posted means you accept the updated Terms.

These Terms are governed by the laws of South Africa. Any disputes arising from these Terms will be handled under the applicable laws and courts of South Africa.
